PURCELLVILLE, Va. June 15, 2021 — On August 4, 2020, former police officer Kris Fraley filed a lawsuit against the Town of Purcellville and several other defendants in the Loudoun County Circuit Court, relating to his former employment. Mr. Fraley had previously filed a similar lawsuit in the United States District Court for the Eastern District of Virginia, which the federal court dismissed on May 22, 2020, finding that the lawsuit was without merit and failed to state any claims under Virginia or Federal law.
In the current Loudoun County Circuit Court case, Fraley alleged 5 separate claims against the Town. On June 7, 2020, the Loudoun County Circuit Court dismissed 4 out of the 5 claims with prejudice, finding that the Town was entitled to Sovereign Immunity for the types of claims made against it, and that the claims are barred. The Town continues to defend the 5th and final claim, and has a motion pending to dismiss the final claim later this month.
